Thematically organized around the major concerns of Basil Bernstein's work as a sociologist, this book includes chapters from some of the leading sociologists and educational scholars. Each section attempts to provide a critical evaluation of Bernstein's work, framed within four interrelated contexts: his sociological theory, sociology of language and code theory, sociology of education and social reproduction, and the influence of his sociology on educational research. In a separate section, Bernstein himself responds to the earlier chapters. The book examines Bernstein's (...) sociology of schools in relation to his general sociological theory and in doing so demonstrates that sociology is an essential lens for understanding the structure and processes of schooling. It also provides a critical evaluation of the strengths and weaknesses of Bernstein's work, as well as a correction to current work in education, which eschews theory in favor of practicality. A company’s trademark is the symbol that allows consumers to know that they are dealing with a particular company. This article addresses the extent to which some companies will go to obtain and protect a trademark. Specifically, it will address the fight between Cisco and Apple over the iPhone trademark, as both (...) companies took questionable steps in the United States and abroad to obtain rights to the iPhone mark. Monetary Intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the bright side of Monetary Intelligence and behavioral economics, frames money attitude in the context of pay and life satisfaction, and controls money at the macro-level and micro-level. We theorize: Managers with low love of money motive but high stewardship behavior will have high subjective well-being: pay satisfaction and (...) quality of life. Data collected from 6586 managers in 32 cultures across six continents support our theory. Interestingly, GDP per capita is related to life satisfaction, but not to pay satisfaction. Individual income is related to both life and pay satisfaction. Neither GDP nor income is related to Happiness. Our theoretical model across three GDP groups offers new discoveries: In high GDP entities, “high income” not only reduces aspirations—“Rich, Motivator, and Power,” but also promotes stewardship behavior—“Budget, Give/Donate, and Contribute” and appreciation of “Achievement.” After controlling income, we demonstrate the bright side of Monetary Intelligence: Low love of money motive but high stewardship behavior define Monetary Intelligence. “Good apples enjoy good quality of life in good barrels.” This notion adds another explanation to managers’ low magnitude of dishonesty in entities with high Corruption Perceptions Index. In low GDP entities, high income is related to poor Budgeting skills and escalated Happiness. These managers experience equal satisfaction with pay and life. We add a new vocabulary to the conversation of monetary intelligence, income, GDP, happiness, subjective well-being, good and bad apples and barrels, corruption, and behavioral ethics. (shrink)

The harmful impact of an adverse event ripples beyond injured patients and their families to affect physicians, nurses, and other health care staff that are involved. These “Second Victims” may experience intense feelings of anxiety, guilt, and fear. They may doubt their clinical competence or ability to continue working at all. Some go on to suffer post-traumatic stress disorder and depression.Medical institutions long ignored this problem, preferring to believe that adverse events, or “errors,” occur due to incompetence — the unfortunate (...) work of a few “bad” practitioners who deserve, if anything, a reprimand for their negligence. Study after study has rejected this attribution and shown that adverse events in health care stem primarily from systemic flaws, not “bad apples.” Devastating errors, in other words, can, do, and always will happen in the care of competent, well-trained, and caring practitioners. We have compared two different laser-induced optical light traps for their utility in moving organelles within living animal cells and walled fungal cells. The first trap employed a continuous wave neodymium-yttrium aluminum garnet laser at a wavelength of 1.06 micron. A second trap was constructed using a titanium-sapphire laser tunable from 700 to 1000 nm. With the latter trap we were able to achieve much stronger traps with less laser power and without damage to either mitochondria or spindles. Chromosomes and (...) nuclei were easily displaced, nucleoli were separated and moved far away from interphase nuclei, and Woronin bodies were removed from septa. In comparison, these manipulations were not possible with the Nd-YAG laser-induced trap. The optical force trap induced by the tunable titanium-sapphire laser should find wide application in experimental cell biology because the wavelength can be selected for maximization of force production and minimization of energy absorption which leads to unwanted cell damage. Recently, Jonathan Bennett has said some interesting, but mistaken, things about certain themes in Berkeley's philosophy. His comments are interesting because they direct us to a careful scrutiny of Berkeley's arguments and methodology in the often neglected Draft to the Introduction to the Principles, and mistaken because Bennett misinterprets these arguments and methodology. I would like to correct those mistakes because an understanding of Berkeley's Draft is helpful in interpreting the Introduction, which in turn is important for our understanding of (...) not only his philosophical methodology, but also for an adequate interpretation of some of his substantive philosophical claims. I will argue that Bennett misinterprets Berkeley's deleted comments and arguments concerned with two Lockean themes, classification and understanding, as presented in several passages from the Draft which did not appear in the published Introduction to the Principles. In both cases Bennett's confusion is a failure to grasp Berkeley's strategy and target in his attacks upon Locke and the theses he takes Locke to hold. Read in their unedited form the deleted passages not only indicate that Bennett misinterprets them, but they also are suggestive of some interesting philosophical comments on Berkeley's part. The passing on of information to GPs by genito-urinary doctors is to be encouraged but is not always possible and ultimately the patient's wishes and confidentiality must be respected if sexually transmitted diseases and HIV infection are to be controlled. Infected health-care workers should seek counselling and medical support and clear guidelines from professional organisations which are in existence. However, they will only do so if strict confidentiality is maintained and assurance about future employment can be given.

This article conducts a normative evaluation of Operation Iraqi Freedom undertaken in 2003 by employing principles of prudence to enquire whether the use of force could be described as an action by a responsible great power. Along with relating the principles of prudence to the concept of great power responsibility, it highlights two pillars of prudent decision-making: circumspection and awareness of one's limits. This normative framework is then utilised to evaluate the invasion of Iraq from the perspective of these specific (...) aspects of prudence. The conclusion shows that on the basis of this normative yardstick, it is not possible to classify Operation Iraqi Freedom as a prudent action by a responsible great power. (shrink)

Precision Medicine has become a common label for data-intensive and patient-driven biomedical research. Its intended future is reflected in endeavours such as the Precision Medicine Initiative in the USA. This article addresses the question whether it is possible to discern a new ‘medical cosmology’ in Precision Medicine, a concept that was developed by Nicholas Jewson to describe comprehensive transformations involving various dimensions of biomedical knowledge and practice, such as vocabularies, the roles of patients and physicians and the conceptualisation of disease. Subsequently, I will elaborate my assessment of the features of Precision Medicine with the help of Michel Foucault, by exploring how precision medicine involves a transformation along three axes: the axis of biomedical knowledge, of biomedical power and of the patient as a self. Patients are encouraged to become the managers of their own health status, while the medical domain is reframed as a data-sharing community, characterised by changing power relationships between providers and patients, producers and consumers. While the emerging Precision Medicine cosmology may surpass existing knowledge frameworks; it obscures previous traditions and reduces research-subjects to mere data. This in turn, means that the individual is both subjected to the neoliberal demand to share personal information, and at the same time has acquired the positive ‘right’ to become a member of the data-sharing community. The subject has to constantly negotiate the meaning of his or her data, which can either enable self-expression, or function as a commanding Superego. (shrink)

According to some, the combatant-noncombatant distinction has lost its relevance in today’s world. I examine two arguments to this effect. The first states that the distinction has become irrelevant when it categorizes children as combatants. I reply that the distinction has nothing to do with innocence or guilt, but with the degree to which a violent group poses a threat to others, even when it does so legitimately. The second argues that every civilian can be construed as a kind of (...) combatant, thus obliterating the distinction. My answer notes an error: states are representatives of citizens, not the other way around.My position in this paper is that individuals take on legitimate combatancy as a function of membership in an organization with legitimate combatancy. This paper attempts to construct a concept of the fighting organization that will allow us to determine the legitimate combatancy of such organizations. The three combatancy criteria I offer are military command structure, observance of the war convention, and representativeness. The first is a requirement for legitimate combatancy because it facilitates the prevention of ius in bello violations of the war convention and can enable the transition from war to diplomacy. My second criterion, the observance of the war convention, too, must be retained as a condition for legitimate combatancy: targeting noncombatants as a means of fighting the war certainly disqualifies organizations from potential POW status, and other ius in bello infractions might, as well. My third condition, representativeness, requires that fighters serve as moral proxies for a geographically contiguous, politically viable people in order to retain legitimate combatancy. If a fighting organization does not represent such a people, then it is a group of criminals rather than soldiers. (shrink)

The formulas-as-types isomorphism tells us that every proof and theorem, in the intuitionistic implicational logic $H_\rightarrow$, corresponds to a lambda term or combinator and its type. The algorithms of Bunder very efficiently find a lambda term inhabitant, if any, of any given type of $H_\rightarrow$ and of many of its subsystems. In most cases the search procedure has a simple bound based roughly on the length of the formula involved. Computer implementations of some of these procedures were done in Dekker. (...)
